If you don't sell it, sure. If you are planning on selling or profiting off it you will always run into legal problems no matter how old the sample is.
 
If your serious about making a hit from the sample you get permission from the person who owns the rights/license to the song your sampling, or strike some kind of deal a percentage of money's gained.
I think in the copyright act 1976 mentions access to record music something like 70 years after the composers death, however sampling a modern performance of a 70 years dead composer brings with it it's own copyright performance issues.
 
no - people will sue because you stole their creative endeavours, not because you did or didn't make money from exploiting them

get a clearance otherwise do not release it

if you are seeking guidance from others on how to improve your work, posting it here at fp (or other music sites) should be fine under the fair use doctrine of use for educational purposes

ps if in doubt get a legal opinion from a competent attorney/lawyer licensed to practice law in your jurisdiction
