Sample clearances: Who's responsibility?

its LAW.....you cant sell copyrighted material as your own if you dont have permission to use the piece in your work from the get go....

what part of that doesnt make sense to you......wtf do you think a copyright is for.....


then again your from the uk.....

how is it not? by ur logic i can go out and sell 50 Cent cds without permission. Yea its copyrighted and its not mine and legally no u cant sell something that isnt urs without prior permission. This is basic stuff u should have learned before grade school. In reality people dont do that tho. They make the beat then let artist deal with the legalities. Its one of those it aint illegal if i dont get caught things.

does anybody know of a good (preferably easy or in layman's terms)
book on this side of music/ music law?
i just don't wanna have to read a fricken law book ya know. somthen like a dummies guide to music biz type stuff?
 
i dont! but dude, seriously, why d you care?!! if your big time enough to be worth gettin sued, you will have a lawyer, & if your not, well as the rock said IT DOESN'T MATTER!!!!!
 
back to reality, the more you know the better off you are an the less you get screwed. this is called common sense. :)
also when your shoping around to production agencies and to advertising firms it's good to know about the technicalities.

second, i jus think that your time would be better spent practisin & experimenting, raather than readin books on stuff that you'll probably never use!
 
sorry not to sound rude by why would you never use this info?... i agree it's not the most fun nor interesting topic. but as it goes if your in the game for real then you better know the rules... right?... thats what i was refering to as the common sense part.

my point earlier was if u are worth being sued, then your gonna be able to afford people to stop u gettin sued.

so yes we have a difference in opinion & no i dont want to row on a forum about a trivial difference in opinion,

my advice:


forget the book, work on your skills so you can be in a position to be worth getting sued one day... and pay somebody to ensure you dont get sued

Just thought I'd throw something else in here. It is a common practice for artists to pay a "deposit" for your beat, lets say 1/2 of the full price, which they have to pay you whatever. If they can't clear the sample then that is all you get, and you would only get your second 1/2 if they are able to clear the sample.
