I Got a Strategy for selling mixtapes...but is it legal???

dawg u r a producer too right just sell ur cds. but make one version with about 5 songs on it and let it sell for 5. then make another one with like 10 songs on it raise the price up to 10 then throw in a "free" cd with it.

^no lol...tha bong was supposed to represent a CD cover and the weed would be the CD with the music on it...it's hypothetical...

but yea I might sell tha tapes I make original beats on and give away tha tapes that have industry beats on them...f*ck that being illegal talk...probably got gonna have to worry about that until I get to a major level...then that's when they'll be watching you...

just use original beats, with no samples...then u can do whatever....

that one mixtape site uses stickers, sells them and offers a free mixtape...i havent heard them get shutdown....add a disclaimer
 
Look, all these schemes are sketchy to me. Bottom line: if you want to operate within the law, be fair to the musicians and producers who made the original music: clear the samples. Otherwise, no matter how you deliver the music, free, 'stickers', giveaway, paid, it's all illegal.

Yes, you can get away with a great deal on the sly but its no way to run a business. If you plan to use samples in your work as part of your business, then you need to learn the skills of negotiation, budgeting, and planning so that you can be profitable, respected, and known. And practicing those skills on your lowly mixtape will help you more than the few dollars you earn peddling them, as those skills will apply to any successfully run business and the things you learn about the companies who own the samples will help you in higher stakes negotiations later.

You can ask for anything - "I want to use these samples for free". "I'll send you the first $50 I earn after I cover my costs. How about it?" The worst they can say is "no". Then you do the next logical thing, replace the samples with ones you make yourself. It might be better for you in the long run anyway.

Mixtapes are illegal to sell due to most the beats on them either being leases and being sold without the producers consent, or, there are samples on it which haven't been cleared. Either way it doesnt stop people from handing out there mixtapes out here in NY and asking for "Donations" lol
 
Aight I've been thinking about a way that I can sell mixtapes without gettin punished for it...and I was thinking...if I'm about to get punished for selling tapes can I say that I was charging the consumer for the tape's cover...and a free CD was included? I just wanna see if it's legal and whether or not I should do that...

There's absolutely no justification for using other peoples work as your own. In other words, your illegally selling music if you don't have written permission to do so. I suggest you start buying your way into the business, instead of stealing your way in. No matter what you say, or how you say it, you need to own the copyrights. If you don't own the copyrights, you need permission from the person or company that does. Instead wasting energy looking for loopholes in the system, create your own songs and copyright them. Buy or lease the right to distribute beats that weren't created by you. This way, you won't have any legal issues.
