Great Thread!! Do you by chance have a Venue Rental Contract? I need one that I can send to venues that agree to let me throw a show at their place of business. I'm new to the site and already have found that this is the most informative place i've came across.

Hello everyone :)

I hate to be a nuisance and ask a question that has been answered before but all of this is really beyond me.

Does anyone by chance have a contract tamplate that I as a film maker can use when working with musicians to gain their permission to use a song in a movie?

What I'm wanting to do is name the musicians in the credits and give them a copy of the final product. They would not be paid and I would have no rights to alter their music other than maybe using only some parts of songs. I want to assure them that their music will not be used in any other productions other than those they explicitly agree to in the contract. This would be for low budget movies (we can't afford to pay for songs at this time) and the songs will be coming from local, unsigned bands looking to promote their music through our movies.

Nevermind... I figured it out. I borrowed someone else's contract on here and adjusted it to suit my needs. This is tailored to a situation wherein a person wants to solicit free music to put into their movie. Comments and suggestions are welcome.

FILM MASTER USE LICENSE AGREEMENT

2. Composer warrants that it has the right to grant this license, that it owns and controls one hundred percent (100%) of the right, title and interest in and to Recording and that the use of said Recording hereunder will not violate the rights of any third party. Composer shall indemnify costs, losses, damages and expenses (including reasonable attorneys fees) arising out of any breach or failure of any warranties or covenants made by Composer herein.

6. Subject only to the rights herein above granted to Producer, all rights of every kind and nature in said Recording are reserved to the Composer, together with all rights of use thereof. However, in no event shall Producer have less rights than a member of the public would have in the absence of this license.

7. No failure by Producer to perform any of its obligations hereunder shall constitute a breach of this license, unless Composer has given Producer written notice of such non-performance and producer fails to cure such non-performance within thirty (30) days of its receipt of such notice.

8. Composer's rights and remedies in the event of a breach of this license shall be limited to Composer's right, if any, to recover damages in an action at law.

9. Producer agrees not to manufacture or distribute sound recordings (including soundtrack albums, promotional CDs, and any and all methods of sound recording) separately from actual positive prints of the motion picture and directly integrated media (such as digital recordings to be used in theaters as part of a theater digital sound reproduction system).

10. Producer agrees to obtain all synchronization licenses necessary to utilize the musical compositions embodied in the Recording in the soundtrack of the Film and any related entertainment products such as promotional films and advertisements.

11. Producer agrees to pay all musicians' re-use, new-use, and all residual payments of any kind related to this use of the Recording.

12. This license shall be governed by and subject to the laws of the State of _____STATE_____ applicable to agreements made and to be wholly performed therein.

13. This license is binding upon and shall inure to the benefit of the respective successors and/or assigns of the parties hereto.

C. Sell, license, distribute, sub-distribute, export, and import said recordings and/or copies from and into any country or territory throughout the universe; and

D. Perform said musical composition throughout the universe but only in synchronization or timed relation with the motion picture identified below, upon and subject to the terms and conditions set forth below:

6. This license shall remain in full force and effect for the duration of all copyrights in said musical composition, including any renewals and extensions without Producer having to pay any additional consideration thereof.

7. The recording rights granted in (a) above may be exercised by any and all means, methods, and systems of recording sound in synchronization or timed relation with motion pictures, whether now known or hereafter devised.

8. Publisher warrants that it has the right to grant this license, that it owns and controls one hundred percent (100%) of the right, title and interest in and to said musical composition and that the use of said musical composition hereunder will not violate the rights of any third party. Will someone help me out please how i can word this different? i dont really want to be sorting out music clearance forms and i dont really understand what it's trying to say

this means the he will be considered a co-author on the SR Form when the Artist Copyrights the finished work..

also you can have the artist send you a copy of the copyright to make sure they have you on there as a co-author...hed wanted to do it so he will know he is on the work 4 sure.. you can re-word it to fit your need and wants..
 
What type of contract would I use when signing someones track to a label, making them the holder of the copyright, but granting me use of the track for the label in CDs and general digital release?
