what you shakin ya head for? piracy?! yeah man, trading samples is still a form of piracy! if you are not the original purchaser of the sound kit, and didnt obtain a legitimate license to use the sounds, then you are pirating. If you have ever bought a sound pack it should say that in the "license agreement"
 
but what are you using to make your drumkits with?

someones samples?
someones sample library?

if you are doing either of those things then you are engaged in piracy
 
weasel words - "it depends" says yes I am using other peoples sample sets which means yes I am pirating/plagiarising other peoples work.

No amount of redesign by applying eq and fx takes away the fact that the original source material is not of your own creation
 
theft is theft, no matter how you dress it up - the fact that these are audio files that you have manipulated does not change the fact that you do not own the rights to exploit them
