I'm hoping someone can clear up the laws of sampling, as in copyright laws. Everything I've read about it states: You cant use anybody elses work of music without getting the permission from #1 the artist, and #2 the company that produced the origonal recording. Many cases you have to pay large sums of cash, and or roalties. This seems like a hard thing to do, but lots of my favorite artists songs are sampled all to ****. And I listen to a lot more undergound than mainstream, so I'm sure they cant afford to be paying for the rights to use these samples.
(i know most of the samples are credited in the song notes inside the case though)
So how are they doin' it, are they just using it hoping they never get caught or is there some way around this ish. I need to know cause I was reading about some record companies just starting out, get a decent song on the radio, then POW, the audio police come crashin' in sayin' you didn't get the rights to this! Your done son!
I don't want that to happnin' to me, cause I'm just startin' out as well. Is this just a stupid thing to ask, and am I just being paranoid or WTF!

small labels usually have a finicial backer who can pay $1000-$5000 for the use of a sample then some small amount of royalities.... depending on who owns the rights to the song and what not....
some charge more...
I would like to know if anyone on here has paid for a sample clearance....
and how much they paid... so if you done this enlighten us please.....
but most of us our just producers and leave it up to the record labels and/or to clear samples...
but we always make sure we give the artist all the information for the sample and state in the contract that we as producers are not responsible for the sample clearance...

No one knows the laws of sampling cause there aren't many. Currently, it's accepted that you have to pay for samples. It's the practice that the record label pays to clear samples, and realistically a sample holder will only sue a record label since they have the money rather than joe producer who prob doesn't.

Word, I dig this, but I'm makin' beats for myself and the crew to rap on you know tryin' to be the full package, hehehe Producin' , masterin', engineerin', promotin' everything. I want to be an indie record label eventually, and I would clear samples when I get the funds rollin'. the problem is will they try to take me out before It's my time, because I used samples in my tracks! I appriceate the advice. I guess maybe i'll just run with it and see what happens LOL! I also heard that if the work was made 30 years ago it didnt have to be cleared, or maybe it was 50 years. Anybody know that one.

That's actually a good point. I'm just wondering what will happen even on indie labels when facing sample clearance issues. I'm still unsigned and what not, I'm just trying to make more beats to add to my collection before I start promoting myself and contacting labels and so on. Alotta good info on this thread though.
