I have an artist who has a beat with Lil Wayne on the hook, I want to know if it's legal to use that for a mixtape

this may not be the right forum, but that is technically considered sampling, but if this is the wrong place let me knowww

it would be copyright infringement if you use it without permission, as would be a sampled beat. are you actually gonna get in trouble, i HIGHLY doubt it

sorry for not being clear about that part, I meant for non-profit use, it's not for sale.

If you're not selling it you should be fine. And even if you were selling it, you would have to sell a crap load (I'm talking 100,000 +) to even be noticed. It costs a lot of money for an artist to take you to court, and if you aren't making a lot of money then you most likely will stay under the radar. I'd only worry about sample clearance if you were signed to a major or well known indie label.
