Before the fairly recent law change, I think it was legal to take something past a certain length or amount of notes. Now it's technically illegal to lift even a single sound. I know people have been sued for taking loops and obvious samples. But the way I like to sample is to take stabs, hits, and just little sounds that can add color to a track and be useful for layering with other sounds. Have you heard of any infringement cases where someone got sued for taking single sounds?

The current law has been the same for awhile. You basically have to use judgement. If you arn't making money, or any sizeable amount of money, it's going to be hard for someone to sue. If you arn't distributing the music enoungh to let the people who can sue you hear it, they obviously won't sue. Etc, etc. When sampling, it's all about judgement.
