With all this legal talk regarding sampling it really is starting to make me wonder if sampling a song is really worth all the hassle. What do you guys think?

Personally, I try not to sample too much and just use synths, but isn't sampling a big part of making hip hop music?

Hellz yea its a big part of making hip hop music. S***, Hip hop started with sampling. I tend to sample because I like the sound you get when you sample. It gives the song a "fuller" sound. But thats my opinion. I think it's worth it. Anywayz you only need to clear it if you are publishing a commercial release.

My mans has a cousin who raps and my other dude knows the music business but isnt in it, and they both told me that if you sell a certain amount indie that you need to get it cleared as well, I think its like 10,000.

I don't sample but I always thought getting the sample cleared was up to whoever you sold the track to (artist\label), and the producer just has to make them aware that there are samples used in the track and where they came from.

Technically sampling is illegal whether anyone hears the beat or not. You could sample a record, make a beat and then delete it all in the space of an hour and you still broke the law.

But are you gonna get caught? Probably not. I've heard underground tracks with obvious samples in that probably aren't cleared. If you want to be safe you should clear your samples, but 9 times out of 10 you will get away with it. Unless you're making real noise no record label is ever gonna hear that anyway, so you needn't worry

It's still not legal if you don't make money off it, but the record company wouldn't sue anyone who isn't making money. Since they wouldn't have anything to gain by that, and it wouldn't be worth their legal fees. They'll only take action if a lot of money is made, and it's worth the time and effort for their legal team to pursue it.

how many records do u sell a year? i say just make beats n be creative dont think about sample laws when ur making music.

when u got a collection of beats then u can decide which ones r feasible to use, but if ur not selling to major artists/and or selling less then 50, 000 units then sample clearance aint really a concern so no need to get ahead of urself.
