Whats the rules on sending a sampled track to a label

Cant seem to find the answer but im wanting to know if its a bad idea to send a demo track to a label that uses a very short vocal sample from a old track.

Do you have to clear it with the original artist/label before you send it to the label of your choice or is this something thats done by the label of your choice

How To Get Legal Clearance For Music Samples

Let's say, you're with a major label and your song becomes a hit. You need to clear the sample with the owner and publisher.
You can say, **** it and disguise it (the sample) so no one will notice what it exactly is as there are several ways of doing it.
Or join a small independent label with a limited run of releases far under the radar of major labels, mainstream bullshit etc...........:)

or better yet as you are selling your beat to the label make it clear in the contract of sale that they are responsible for securing the clearance to use the sample separate to what they pay you

i.e. shift the responsibility to them as the organisation that is going to exploit the track
