I just read a post about Mac Miller being sued for using samples on his "Macadelic" and by Lord Finesse and Now Wiz and Curren$y are scared so they've put a stop to there mixtape to clear samples. Does this mean that the mixtape game is officially dead? If Mac Miller loses at least one of his cases, new artists looking to come up in the game are going to have a hard time. What do you guys think?

NO, Samples used on mixtapes are going to have to be cleared which is fair in my opinion since the artists actually make money, so why shouldnt the original artists be compensated.

All producers, except sample based producers should be happy.

If you are famous enough to get screwed...why worry? If a couple of samples got you on to a point you have a name for yourself with a great fanbase....would the greed of the owners of the sample put a halt to your career or would more fans love you?....which would equal "more money." You can make more money in one show than when you were nobody hoping for feedback. You lose money....you still have more money than you did before. SO TAKE PEOPLES WORK AND RUN WITH IT. You may never have a chance. Don't be skead!!!

Kill the DJ. Soon the DJ's will get sued because they are cutting and scratching records for artist to perform with. Which would really be greedy and pathetic.

Fight for your right to sample.

To further break down what Rice was getting at:

Do you spend lets say for example 20g's that you don't have trying to clear some samples for your mixtape or do you blow up, make a mill or two and then settle with the copyright owners for $100k when they sic the legal hounds at you? After that you will now have the proper budget to clear your samples prior to release on any future projects.

If nothing comes out of your mixtape (which is the case for 95% of ALL artist mixtapes) then you have nothing to worry about in terms of being sued. Even though legally the original copyright owner(s) have the right to but it makes no sense financially .

Now if you CAN afford it from out the gate then you can roll the dice and pay up front if you're pretty confident the free mixtape project is worth the investment. Very few will do that and opt for sample-free production instead but for an artist like Mac Miller with his style of hip hop he may have never blew up to that level if he DIDN'T use those samples

What if I were a motivational speaker and photoshopped a photo of me sitting down with Oprah on my website.... but I actually had never been on Oprah.

Sampling Oprah would be one big farce since I didn't have Oprah's blessings... BUT! I was getting clients and bookings because I "sampled" Oprah.

Same thing with music. Put some GOOD UNCLEARED music behind you and you get booked, you get fans, you could even get a record deal... off of the backs of the peoples music that you used.

Rap acapella and see how many fans, endorsements and deals you get.

... these guys are "indirectly" making money from using other peoples music. I don't care if they get sued.

Pay the producers that don't sample and they'll be in the clear.

Why are they suing the artists though, doesn't the producer share some of the blame? They actually sampled the record, lol.

personally i'm all for illegal samples as long as it's original, i think rapping over "industry beats" can be wack though, i don't wanna hear wack verses over "juicy" for example. get your own damn beats.

^^^I hear a lot of people when they sell beats with samples in it they tend to put it in the contract that the purchaser is paying for the arrangement of everything around the samples and that the purchaser has to clear the samples themselves
