Samples and copyrights

Have to use the opportunity when you are here to pop another question

Since you are the master of sampling you probably know a lot about the copyrights and all the laws.

How does it work if I where to use f.eks an old 10 second brass sample from the 1970. in my track?

For instance if we take the Amen-break, the drummer from the group didn't know before long after the jungle era, that his drumbreak was used, and he had not gotten any money from all the sampling that had been made of his break.

Is it common to register all you samples? I have a collection of hungarian folk music that I don't know every artist or composer on the tracks. So how would you go forward if you where to use any of those samples?
