Using Drum Samples Found Online

I always download those "freebies" people be posting online, like the Shawty Red 808 Drum.
So if i use these in my own tracks do i have to get sample clearances. How do you know which ones are safe to use.
 
If it's not a set of samples that you recorded yourself (personally) from drums that you own, and it's not a set of samples that came with some kind of licensing agreement that gives you unlimited rights to use them royalty-free in your productions, then you are possibly exposing yourself to a lawsuit. Not saying that you're going to get sued, just that that is always a possibility...

- does the sample set even have a license attached?
-- if there is no license then I would wary of using them as they may not be sampled legally, which can lead to all sorts of other problems later
- what are the terms of the license ?
- does it limit you in any way as to how you can use them?
